Steps for Local Governments to Participate in the Settlements

The State of North Carolina has already approved and signed the settlements, making North Carolina local governments eligible to participate. Each of the proposed Settlements has two key participation steps:

  1. Each state decides whether to participate in the National Settlements. North Carolina has joined both Settlements.
  2. The subdivisions within each participating state must then decide whether to participate in the Settlements via the NC MEMORANDUM OF AGREEMENT (“NC MOA”)

Follow these steps:

  1. The first step in this process is for local governments to sign on to the national settlements by January 2, 2022.
    Take the following actions:
    1. Verify Registration Code
    2. Select your state, your political subdivision, enter your Subdivision’s unique registration code to register in order to Receive Participation Agreements for Distributor and Janssen Settlement Agreements.
    3. Click “Verify Registration Code” at the bottom of the form to complete the registration process.
      • As part of the registration process, your subdivision will need to identify, and provide the email address for, the individual who will be authorized to sign formal and binding documents on behalf of your subdivision.
    4. Monitor your email for further communications, which will include a Participation Agreement, Release, (where applicable) a model Resolution, and instructions on executing and submitting electronically using DocuSign.     5. Sign the Participation Agreements for Distributor and Janssen Settlement Agreements BY JANUARY 2, 2022.
      • All required documentation must be executed and submitted electronically through the website and must be executed using the “DocuSign” service.
      • If you have questions for the Attorney General’s Office, you may contact it at opioidsettlement@ncdoj.gov.
      • The Attorney General’s Office, your counsel, and other contacts within the state are available to discuss the specifics of the Settlements within your state, and we encourage you to discuss the terms and benefits of the Settlements with them.
  2. After signing the National Participation Agreements, sign the NC MEMORANDUM OF AGREEMENT (“NC MOA”)
    The MOA agrees how settlement funds will be distributed in North Carolina.
  3. Determine the projects to receive funds out of the local government’s share from the settlement funds.
  4. Distribute the funds to the organization for the designated projects.
